Supreme Court blow on private medical colleges

Private technical and medical colleges demanding capitation fee from students is illegal and unethical. Supreme Court has asked the Centre to make laws to put an end to such practices which deny admission to meritorious financially poor students in those institutions.

 Excerpts from the order by bench of Justices K S Radhakrishnan and A K Sikri

 
·         Collection of large amount by way of capitation fee running into crores of rupees for MBBS and postgraduate seats, exorbitant fee, donation etc, by many of such self- financing institutions, have kept the meritorious financially poor students away from those institutions.

·         Pressure, it is also seen, is being extended by various institutions, for the additional intake of students, not always for the benefit of the student community and thereby serve the community, but for their own betterment.

·         We cannot lose sight of the fact that these things are happening in our country irrespective of the constitutional pronouncements by this court in TMA Pai Foundation case that there shall not be any profiteering or acceptance of capitation fee etc.

·         Central Government, Ministry of Health and Family Welfare, CBI, or the Intelligence Wing have to take effective steps to undo such unethical practices or else self-financing institutions will turn to be students financing institutions.

  1. One hand giveth and the other taketh away. I wish justices Altamas Kabir, Justice Dey,Justice Radhakrishnan, and Justice Sikri could have confabulated before the NEET judgment. Honourable SC needs to be clear; Is it good or bad in law and for nation that private medical colleges have a free hand in manipulating admissions.

EXCELLANT JUGEMENT IT APPEARS OUR LAST CJI PASSED SUCH A NOTORIOUS JUDGEMENT ON THE DAY OF HIS RETIREMENT PUSHING ALL MERITOREOUS MEDICAL STUDENTS TO HELL AND PRIVATE MEDICAL COLLEGES ENCOURAGED TO EARN IN CRORES AS IF INDIA IS A BANANA STATE .OTHER JUDGEMENT PASSED BY SAME CJI ON A COMANY MATTER WAS ALSO REVERSED BY OUR PRESENT CJI.WHY HE DID SO HANGING RESULT OF NIIT FOR MORE THAN 09 MONTHS DELAYING COURSE OF MEDICAL STUDENTS FOR ONE YEAR AND PUTTING AN END TO NIIT IF MCI CANNOT CONDUCT EXAM THEN WHO WILL CONDUCT ,WILL IT BE CONDUCTED BY PRIVATE MEICAL COLLEGES WHO INFACT DONOT CONDUCT ANY EXAM OF MBBS ENTRANCE OR PG FAIRLY,EVERY THING DECIDED BEFORE EXAM AND THOSE WHO PAYS IN ADVANCE RS.50-60 LAKHS FOR MBBS AND RS 1-2 CRORES FOR A PG ARE ADMITTED,EXAMS ARE FAKE AND OF NO USE ,IT IS ONLY ON PAPERS.
    ALL MPS,MLAS,BUREAUCRATS,MINISTERS,EUCATIONISTS,MEDICAL GRADUATES,POLICE,CBI,SENIOR DOCTORS,JUDGES,PRESS KNOW IT BUT OF NO USE AS THEY ARE RUN BY TOP POLITICIANS,DOCTORS,EX JUDGES,BANK PERSONS,TEACHERS,EX BUREAUCRATES AND ADVOCATES SO INSPITE OF SOMANY RAIDS AND STING OPERATIONS NOTHING HAPPEN TO THEM,THEY SIMPLY FOURISH AND EVEN GET RECOGNITION BY MEDICAL COUNCIL OF INDIA AND EVEN GET MORE PG AND MBBS SEATS ALLOCATIONS INSPITE OF NO GOOD TEACHING FACILTIES AND FACILITIES AT THEIR INSTITUTE AS OUR ELECTION COMMISSION HAS NEVER TILL TODAY HAS DEMOLISHED MLA OR MP CANDIDATURE AS OUR SPORTS MINISTRY CANNOT CONTROL BCCI AND OTHER INDIAN OLYMPIC AND SPORTS FEDERATIONS SO TILL TODAY NO EXAMPLE IS PRESENT WHERE A PRIVATE MEDICAL COLLEGE IS BEING CLOSED EVEN AFTER DERECOGNITION THEY DO ADMIT STUDENTS AND GET CLEARANCE FROM MCI after a good bribe to minister or mci or anyother influential persons.
    THANKS TO JISTICE RADHAKRISHNAN AND SIKRI WHO PASSED SUCH JUDGEMENT,SIR LIKE COAL SCAM OUR SC SHOULD ALSO MONITOR IT AND TAKE ACTION IF OUR GOVERNMENT ,MCI OR CBI DONOT TAKE ACTION DUE TO EITHER MONETARY OR ANY OTHER PRESSURE IF PRIVATE MEDICAL COLLEGES DONOT STOP EARNING THEIR RUPPEE MINTING MACHINE BY STARING MBBS OR PG TEACHINGS.

  3. i think first Supreme court should implement NEET that will be the first step to see that meritorious students get into good medical colleges , only then good doctors will be made

  5. Judgement is good one,but implementation of it should be strict and without any loopholes.India is famous for alternate paths.
